The ultimate decision and responsibility is from each physician. The guidelines should not be followed blinded, if so we would not need physicians taking decisions, just guidelines dictating management. MIS repairs in my hands give less pain for the first 2 weeks. If I feel able to achieve the repair after a previous posterior repair, I don’t see any malpractice. But, again, the general indication is to return in a different plane, but this should be tailored by each individual surgeon that claims responsibility of the decision and follows his/her own patients
